1. Acceptance of Terms

By accessing or using Jostavan ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and Jostavan ("we," "our," or "us").

2. Description of Service

Jostavan is an AI-powered platform that enables users to build, deploy, and manage web applications through natural language prompts. The Platform provides AI agents that generate code, manage infrastructure, deploy applications, and integrate with third-party services.

3. Account Registration

To use the Platform, you must:

  • Be at least 16 years of age.
  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized access to your account.

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits and Billing

4.1 Credit System

The Platform operates on a credit-based system. Different actions consume different amounts of credits. Free accounts receive a daily credit allowance. Paid plans provide monthly credit allocations as described on our pricing page.

4.2 Paid Subscriptions

Paid subscriptions are billed in advance on a monthly basis. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice to subscribers.

4.3 Credit Expiration

Free daily credits reset each day and do not roll over. Monthly credits from paid plans reset at the beginning of each billing cycle. Unused monthly credits do not carry over to the next billing period.

5. User Content and Generated Applications

5.1 Your Content

You retain ownership of prompts, files, and other content you submit to the Platform ("User Content"). By submitting User Content, you grant us a limited license to process, store, and display such content as necessary to provide the Platform's services.

5.2 Generated Content

Applications, code, and other content generated by the AI agents based on your prompts ("Generated Content") are provided to you for your use. You are responsible for reviewing and validating all Generated Content before use in production environments.

5.3 AI Limitations

AI-generated content may contain errors, inaccuracies, or security vulnerabilities. The Platform provides tools and infrastructure but does not guarantee the quality, security, or fitness for purpose of any Generated Content. You are solely responsible for the final applications you deploy and make available to end users.

6. Acceptable Use

You agree not to use the Platform to:

  • Generate content that is illegal, harmful, threatening, abusive, or discriminatory.
  • Build applications that facilitate illegal activities or harm to others.
  • Attempt to reverse-engineer, decompile, or extract the Platform's underlying models or systems.
  • Circvent usage limits, credit systems, or security measures.
  • Interfere with or disrupt the Platform's infrastructure or connected services.
  • Impersonate others or misrepresent your affiliation with any person or entity.
  • Upload malicious code, viruses, or other harmful content.
  • Scrape, crawl, or use automated tools to access the Platform without our written consent.

7. Third-Party Integrations

The Platform integrates with third-party services (such as Google, Slack, Notion, Stripe, and others). Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the availability, functionality, or data practices of third-party services. You authorize us to access your third-party accounts only to the extent necessary to provide the integration features you request.

8. Deployed Applications

When you deploy applications through the Platform, those applications may be hosted on third-party infrastructure. You are responsible for:

  • The content and functionality of your deployed applications.
  • Compliance with applicable laws and regulations for your applications.
  • Any costs associated with third-party hosting or services beyond the Platform's included allocations.
  • Securing and maintaining your deployed applications.

9. Intellectual Property

The Platform, including its AI models, software, designs, and documentation, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Platform itself. The Jostavan name, logo, and branding are our trademarks.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform, you consent to the data practices described in the Privacy Policy.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOSTAVAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold Jostavan harmless from any claims, losses, or damages (including reasonable attorney's fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may terminate your account at any time through the Platform settings. We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. We may retain your data as required by law or for legitimate business purposes.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Jostavan operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
